1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the AllCampsAndParks website located at allcampsandparks.com (the "Site"), operated by CampBookPro ("Company," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not use the Site.

We may update these Terms from time to time as described in Section 15. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

AllCampsAndParks is a free online directory of campgrounds, RV parks, and outdoor recreation areas across the United States. The Site currently provides:

• Searchable listings of campgrounds and parks, including location data, amenities, contact information, and photos
• Detail pages for individual parks with maps, descriptions, and available contact information
• An inquiry form that allows visitors to send messages directly to park operators
• Informational content such as state guides, "near" pages for popular attractions, and editorial content about camping destinations

We may add features in the future, including (but not limited to) user accounts, owner dashboards, reviews, booking capabilities, and premium listing placements. These Terms apply to all current and future features of the Site.

3. User Accounts

The Site does not currently require user registration. You may browse listings and submit inquiries without creating an account.

If we introduce user accounts in the future, the following terms will apply:

• You must provide accurate, current, and complete information during registration and keep your account information up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us immediately at hello@allcampsandparks.com if you suspect unauthorized access to your account.
• You may not create an account on behalf of another person without their permission or create multiple accounts to circumvent restrictions or enforcement actions.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Conduct and Prohibited Uses

You agree not to use the Site for any unlawful purpose or in any way that violates these Terms. Without limiting the foregoing, you agree not to:

• Submit false, misleading, or fraudulent information through the inquiry form or any other feature of the Site
• Send spam, bulk messages, or unsolicited commercial communications through the inquiry system
• Impersonate another person or entity, or misrepresent your affiliation with any person or entity
• Scrape, crawl, or use automated tools to extract data from the Site beyond what is permitted by our robots.txt file, without our prior written consent
• Attempt to bypass rate limits, security measures, or access controls on the Site or its APIs
• Upload or transmit viruses, malware, or any code designed to disrupt, damage, or limit the functionality of the Site
• Interfere with or disrupt the Site, its servers, or any networks connected to the Site
• Use the Site to harass, threaten, or harm any park operator, visitor, or third party
• Copy, modify, distribute, or create derivative works based on the Site or its content, except as expressly permitted by these Terms
• Use information obtained from the Site (including park operator contact details) for purposes unrelated to camping or recreation inquiries, such as telemarketing, direct mail campaigns, or data resale

We reserve the right to restrict or terminate access for any user who violates these Terms, at our sole discretion and without prior notice.

5. Inquiry Submissions

The Site allows you to submit inquiries to campgrounds and parks through our inquiry form. When you submit an inquiry, you provide your name, email address, and optionally your phone number, preferred dates, party size, and a message.

By submitting an inquiry, you understand and agree to the following:

• Your inquiry information (name, email, phone, dates, party size, and message) will be forwarded to the park or campground you selected, via SMS and/or email.
• Once your information is delivered to a park operator, that operator becomes an independent controller of your data. We do not control how park operators use, store, or protect your information after delivery.
• We store a copy of your inquiry along with your IP address and browser user agent string for fraud prevention and record-keeping purposes.
• We use Twilio for SMS delivery and Resend for email delivery. These service providers process your inquiry data solely to complete the delivery on our behalf.
• Submitting an inquiry does not constitute a reservation, booking, or contract with the park. Any arrangement you make with a park is between you and that park.
• We apply rate limits to inquiry submissions (currently 5 per hour per IP address) to prevent abuse. Attempts to circumvent these limits may result in your access being restricted.

6. Listing Accuracy and Disclaimers

The Site contains listings for over 42,000 campgrounds, RV parks, and recreation areas. Listing data is compiled from public sources, government databases (including Recreation.gov and the National Park Service), and third-party data providers (including Google Places).

We make reasonable efforts to keep listing information current, but we do not guarantee the accuracy, completeness, or timeliness of any listing data. Park details such as amenities, pricing, phone numbers, hours of operation, and availability may change without notice. You should verify all information directly with the park before making travel plans or reservations.

Ratings and review counts displayed on the Site may originate from Google or other third-party sources. We do not independently verify these ratings. If we introduce user reviews in the future, separate terms and guidelines for reviews will apply.

If you claim a listing as a park owner or authorized representative, you will be responsible for the accuracy of any information you provide or update. Claimed listings may display a verification badge to distinguish them from unclaimed listings, but this badge indicates only that the operator has verified their association with the park. It is not an endorsement by AllCampsAndParks or CampBookPro.

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7. Listing Claims and Owner Accounts

If we make listing claim functionality available, park owners and authorized representatives may claim their listings by completing a verification process. Verification methods may include phone verification, email verification, or document submission. We reserve the right to approve or reject any claim at our discretion.

If you claim a listing, you represent and warrant that:

• You are the owner of the park or campground, or you have authorization from the owner to manage the listing
• All information you provide about the park is accurate and not misleading
• You will keep the listing information reasonably up to date
• Any photos you upload are owned by you or properly licensed, and do not infringe on any third party's rights

We may revoke a claim if we determine the claimant is not authorized to manage the listing, or if the listing contains false or misleading information.

8. Future Booking and Payment Features

The Site does not currently offer booking or payment functionality. When booking features become available, supplemental terms governing reservations, cancellations, refunds, and payment processing will be published and incorporated into these Terms.

When such features are introduced, the following general principles will apply:

• AllCampsAndParks acts as an intermediary between travelers and park operators. Any booking made through the Site creates a contract between you and the park, not between you and AllCampsAndParks.
• Payment processing will be handled by third-party payment processors. We will not store your full credit card number or banking details on our servers.
• Cancellation and refund policies will be set by individual parks. We will display each park's policy on the booking page, and you are responsible for reviewing it before completing a reservation.

9. Intellectual Property

The Site's design, layout, text, graphics, logos, icons, images, software, and other content (collectively, "Site Content") are the property of CampBookPro or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

"AllCampsAndParks" and "CampBookPro" are trademarks of CampBookPro. You may not use these marks without our prior written permission.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. This license does not include the right to:

• Reproduce, distribute, or publicly display Site Content except as necessary for ordinary browsing
• Modify, adapt, or create derivative works from Site Content
• Use data mining, scraping, or similar automated data collection methods on the Site
• Frame, mirror, or incorporate any portion of the Site into another website or application without our written consent

Some park photos displayed on the Site are sourced from Google Places or uploaded by park operators. These images remain the property of their respective owners.

If you submit content to the Site in the future (such as reviews or photos), you grant CampBookPro a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce, modify, display, and distribute that content in connection with the operation of the Site.

10. Third-Party Links and Services

The Site contains links to third-party websites and services, including but not limited to:

• Park websites, phone numbers, and email addresses listed on park detail pages
• Interactive and static maps powered by Mapbox
• Affiliate links to outdoor gear retailers (when available), through services such as AvantLink
• Social media platforms (Facebook, Instagram, X, YouTube)

We do not control, endorse, or assume responsibility for any third-party websites, products, or services. Your interactions with third-party sites are governed by those sites' own terms and privacy policies. We encourage you to read those terms before providing any personal information.

Affiliate links, when present, may result in AllCampsAndParks receiving a commission if you make a purchase through those links. This does not affect the price you pay.

The Site uses third-party analytics and advertising services, including Google Analytics, Meta Pixel, Pinterest Tag, and Plausible Analytics. These services may collect data about your browsing behavior as described in our Privacy Policy.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAMPBOOKPRO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, INCLUDING BUT NOT LIMITED TO:

• Errors, inaccuracies, or omissions in listing data, including park contact information, amenities, pricing, or availability
• Any actions taken by park operators after receiving your inquiry, including failure to respond, misuse of your contact information, or disputes arising from your interactions with parks
• Loss of data, revenue, profits, or business opportunities
• Unauthorized access to or alteration of your transmissions or data
• Service interruptions, downtime, or technical failures
• Content or conduct of any third party on or linked from the Site

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply only to the extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless CampBookPro, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Site
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third party's rights, including intellectual property rights or privacy rights
• Any content you submit to the Site, including inquiries, reviews (when available), photos, or other user-generated content
• Any dispute between you and a park operator arising from an inquiry or booking made through the Site

13. Dispute Resolution

Informal Resolution. Before filing any formal proceeding, you agree to contact us at hello@allcampsandparks.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in the State of Delaware, unless both parties agree to a different location or to virtual proceedings.

Class Action Waiver. You and CampBookPro each agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both parties waive the right to a jury trial.

Exceptions. Either party may bring a claim in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

14. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without prior notice. Reasons for termination may include (but are not limited to) violation of these Terms, abusive use of the inquiry system, suspected fraud, or conduct that we determine is harmful to other users or park operators.

If you have a user account (when accounts become available), you may terminate your account at any time by contacting us at hello@allcampsandparks.com. Upon termination, your right to access the Site ceases immediately.

The following sections survive termination: Section 6 (Listing Accuracy and Disclaimers), Section 9 (Intellectual Property), Section 11 (Limitation of Liability), Section 12 (Indemnification), Section 13 (Dispute Resolution), and Section 15 (Governing Law).

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

16. Changes to Terms

We may revise these Terms at any time by updating this page. The "Last updated" date at the top of this page indicates when the Terms were last revised. Changes take effect immediately upon posting.

For material changes, we will make reasonable efforts to provide notice, such as posting a banner on the Site or, if you have an account, sending an email to the address on file. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.

17. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and CampBookPro regarding your use of the Site. Any supplemental terms posted for specific features (such as booking or premium listings) are incorporated by reference.

Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.

No Agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and CampBookPro.
